Texting and driving in South Carolina: can you, or can’t you?

In most states text messaging while driving is illegal, and South Carolina is one of those states. The question may arise about text messaging a red light or stop sign. In the state of South Carolina, you may use your phone at a stop sign or traffic light to text, check emails, read, or look at things, if you are not impeding traffic. When the light turns green, or someone pulls up behind your vehicle, you must stop using your phone and proceed. This law became effective in South Carolina in 2014.

Exceptions to the SC law are as follows:

• vehicle is parked or stopped

• utilizing a hands-free device

• using GPS for directions

• obtaining emergency assistance

• using a digital dispatch system

• if one is a public safety official using phone as part of job duties

A fine of $25 may be issued for text messaging and driving, however they are not reported to your insurance company or go on your driving record.
