SPECIAL REFEREE’S SALE
CASE NO. 2017-CP-15-00537
BY VIRTUE of a decree heretofore granted in the case of Branch Banking and Trust Company against Paula D. Allen, I, the Special Referee for Colleton County, will sell on Monday, November 6, 2017, at 11:00 o’clock a.m., at the Colleton County Courthouse, Walterboro, South Carolina, to the highest bidder:
All that certain lot of land, together with buildings and improvements thereon, situate, lying and being in the Town of Walterboro, County of Colleton, State of South Carolina, known as 707 Carn Street, bounded as follows:
Northeast by lot now or formerly of Gladys A. Turner, Southeast by lot now or formerly of Agnes Glover and others, on the Southwest by Carn Street, and on the Northwest by lots now or formerly of Ray Beach and of Hattie Glover. The said lot, which is the most southern portion of a lot shown and described on Plat of Harry M. Fripp, dated November 15, 1945, recorded in Plat Book 3, at page 214, in the office of the Clerk of Court for Colleton County, South Carolina, as follows,
Beginning at a stake on Carn Street, which is a common corner between the instant lot and lot now or formerly of Agnes Glover, and running thence South sixty-one (61) degree twenty (20) minutes East, 105.3 feet, along the said Carn Street to a stake, thence running North twenty-six (26) degrees thirty-six (36) minutes East, 176 feet, to a stake, thence South sixty (60) degrees nine (9) minutes East, 97.7 feet, to a stake, thence North twenty-nine (29) degrees zero (00) minutes East, 173.8 feet, to the point of beginning.
Said lot is subject to the fifteen (15’) feet driveway easement granted to Gladys A. Turner.
This being the same property conveyed to David S. Allen and Mary J. Allen by deed of Gail E. Jordan, as Personal Representative of the Estate of Mary M. Smith dated November 13, 2001 and recorded November 21, 2001 in the Office of the Clerk of Court for Colleton County in Deed Book 956 at Page 281. Subsequently, the property was conveyed to Paula D. Allen by deed of David S. Allen and Mary J. Allen dated April 18, 2008 and recorded May 5, 2010 in Deed Book 1842 at Page 196. Subsequently, the property was conveyed to Mary J. Allen and Paula D. Allen as joint tenants with right of survivorship by Deed of Paula D. Allen dated July 27, 2011 and recorded on July 28, 2011 in Deed Book 1948 at Page 286. Thereafter, Mary J. Allen died on December 6, 2016 as evidenced by South Carolina DHEC File No. 139-16-043911, thereby vesting full title of the property in Paula D. Allen.

TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Special Referee for Colleton County at conclusion of the bidding, five percent (5%) of the bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of non-compliance. If the Plaintiff’s representative is not in attendance at the scheduled time of the sale, the sale shall be canceled and the property sold on some subsequent sales day after due advertisement. Should the last and highest bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, the deposit shall be forfeited and the Special Referee for Colleton County may re-sell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the said highest bidder). As a deficiency judgment is being waived, the bidding will not remain open thirty days after the date of sale. Purchaser shall pay for preparation of deed, documentary stamps on the deed, and recording of the deed. The successful bidder will be required to pay interest on the amount of the bid from date of sale to date of compliance with the bid at the rate of 4.0% per annum. The sale shall be subject to assessments, Colleton County taxes, easements, easements and restrictions of record, and other senior encumbrances.
